AAP

Affirmative Action Plan


AbilityOne Distributor

Companies (also called dealers) that have been formally authorized by the U.S. AbilityOne Commission® to buy and resell AbilityOne products in accordance with Commission Policy.


AbilityOne Program

The program authorized by the Javits-Wagner-O’Day Act to increase employment and training opportunities for persons who are blind or have other severe disabilities through Government purchasing of commodities and services from nonprofit agencies employing these persons. (41 CFR 51-1.3)


AbilityOne Program Fee

Formerly known as the Central Nonprofit Agency (CNA) Fee. AbilityOne Program funding fee that is the primary source of funding for CNAs (National Industries for the Blind [NIB] and SourceAmerica). Set by the AbilityOne Commission to apply to Procurement List additions, annual price changes for products, base year renewals for services, and bilateral contract modifications that result in a price change submission to the Commission.

Affirmative Action Policy

Employers who do more than $10,000 in federal contracts in one year must establish a nondiscrimination policy. The $10,000 applies to the aggregate value of all federal contract work performed in a year—not the value of any one contract. Covered employers are prohibited from discriminating in employment decisions on the basis of race, color, religion, sex, sexual orientation, gender identity, or national origin.


Affirmative Action Written Program

Written affirmative action programs specify the proactive policies and procedures to be used, assign management responsibility for implementation, and are reviewed and updated annually.

Distribution of orders by the Central Nonprofit Agency (CNA) for items on the Procurement List among multiple nonprofit agencies (NPAs) that have been designated by the Commission to fulfill that particular product or service requirement.

Each nonprofit agency must submit to its Central Nonprofit Agency, by November 1 of each year, two completed copies of the appropriate Annual Certification (Representations and Certifications), covering the fiscal year ending the preceding September 30.


APA

Administrative Procedures Act


Applicant and Employee Self-Identification Invitations to "protected veterans" and individuals with disabilities.

Coverage for these provisions stem from the requirements of the Hiring Benchmarks for Veterans or the Workforce Utilization Goal for Workers with Disabilities. Covered contractors must establish a program that invites both workers with disabilities and protected veterans who are either applicants for a job or employees of the firm to self-identify their respective statuses. This requirement includes reminders to employees that they may update such statuses.

An NPA that has a direct labor ratio below 75 percent or one that is out of compliance for a single reason.


Authorization Violation

Action (or lack of required action) by an AbilityOne authorized distributor which the Commission determines does not conform to the requirements of this Policy (51.540), including its Appendices and its Procedure (51.540-01). Authorization violations may include, but are not limited to, the marketing/sale of a commercial product in lieu of the appropriate AbilityOne item, failing to block and substitute the AbilityOne product at the order entry point, failing to carry all prescribed AbilityOne products, or excessive pricing of AbilityOne products on a contract or schedule.
